First Time DUI Offense

The penalties for DUI offenders with a blood alcohol count (BAC) less than .15, include the following:

  • Jail time: A minimum of 1 day in jail, up to a maximum of 1 year.
  • Fines: A minimum of $823 up to a maximum of $5,000.
  • Driver's license suspension: 90 days.
  • Alcohol counseling: Required.
  • Probation: Up to 5 years.
  • Ignition Interlock Device: Required installation up to 1 year after license suspension.

Second DUI Offense

  • Jail time: A minimum of 30 days in jail, up to a maximum of 1 year.
  • Fines: A minimum of $1,015 up to a maximum of $5,000.
  • Driver's license suspension: 2 years.
  • Alcohol counseling: Required.
  • Probation: Up to 5 years.
  • Ignition Interlock Device: Installation required for up to 5 years if license was previously restricted.

Third DUI Offense

  • Jail time: A minimum of 90 days in jail, up to a maximum of 1 year.
  • Fines: A minimum of $1,805 up to a maximum of $5,000.
  • Driver's license suspension: Three years.
  • Alcohol counseling: Required.
  • Probation: Up to 5 years.
  • Ignition Interlock Device: Required installation for 10 years if previously installed for a 5 year restriction.

Additionally, each DUI offense requires in-home electronic monitoring of 15 days up to 120 days for more serious repeat offenders.
