Field Sobriety Tests

If you are stopped by police, you do not have to be over the legal limit to be arrested for DUI. Failed field sobriety tests can result in unfair charges. Standardized field sobriety test involve three exercises administered and evaluated by police in a consistent manner:

  • Horizontal Gaze Nystagmus - measures involuntary jerking movements of a driver's eyes as intoxicated people can have difficulty tracking a slow-moving object such as a pen or a flashlight passed back and forth about six inches or so in front of the face
  • Walk and Turn: measures a driver's balance and the ability to listen and following instructions by taking a specific number of heel-to-toe steps along a straight line, turning on one foot and returning in a similar fashion in the other direction
  • One-Leg Stand: also measures balance and capacity to follow instruction to stand with one foot six inches off the ground for 30 seconds, and count by thousands (1,001, 1,002,...) until instructed to lower the foot; swaying, using the arms, hopping or putting the raised foot down before being told, are supposed signs of intoxication
